Please read these Terms of Use ("Terms") carefully. They govern your access to and use of www.pinelogistics.com and any related pages, forms, and features we operate (the "Site").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Who we are
The Site is operated by Pine Logistics Corp, a corporation organized under the laws of the Commonwealth of Massachusetts, United States ("Pine Logistics," "we," "us," or "our"). We are a motor carrier operating under USDOT No. 2208011 and MC No. 766135.
In these Terms, "you" means the individual or entity accessing the Site. If you are using the Site on behalf of a company, you represent that you are authorized to bind that company to these Terms, and "you" means both you and that company.
2. What this Site is — and what it is not
The Site is an informational and communication resource. It describes our services, equipment, hiring standards, and compliance practices, and it lets you contact us, request a quote, or apply to drive with us.
The Site is not a contract for transportation services. Nothing on the Site — including any description of equipment, capacity, coverage area, transit expectation, or price indication — constitutes an offer to contract, a binding rate, a guarantee of capacity, or a contract of carriage.
Transportation services are governed exclusively by the documents that apply to the specific shipment, which may include a signed broker-carrier agreement or shipper-carrier contract, an accepted rate confirmation, the bill of lading, and applicable federal transportation law. Where any statement on the Site conflicts with those documents, those documents control.
3. Eligibility
The Site is intended for business users and adults. You may use the Site only if you are at least 18 years of age and legally able to enter into a binding agreement. The Site is not directed to children, and we do not knowingly collect information from anyone under 13.
4. Permitted use of the Site
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site for your own internal business purposes — evaluating our services, requesting a quote, or applying for a position.
This license does not include any right to resell, redistribute, frame, mirror, or commercially exploit the Site or its contents.
5. Prohibited conduct
You agree not to, and not to permit any third party to:
- Use the Site for any unlawful purpose or in violation of any federal, state, or local law or regulation;
- Misrepresent your identity, your company, or your operating authority, or use information from the Site to impersonate Pine Logistics, hold yourself out as an authorized agent of Pine Logistics, or otherwise facilitate carrier identity fraud, double brokering, or freight theft;
- Access the Site through automated means — including scraping, crawling, harvesting, or data mining — except by a search engine operating in accordance with our robots.txt file;
- Attempt to gain unauthorized access to the Site, our servers, or any connected system, or probe, scan, or test the vulnerability of any of them;
- Interfere with the operation of the Site, including by introducing malware, launching a denial-of-service attack, or circumventing any security or rate-limiting measure;
- Use the Site's forms or contact channels to transmit unsolicited commercial messages, chain communications, or bulk solicitations;
- Submit information you know to be false, or submit another person's personal information without their authorization;
- Reverse engineer, decompile, or attempt to derive the source code of any part of the Site;
- Remove, obscure, or alter any copyright, trademark, or other proprietary notice.
We may investigate and take appropriate action — including blocking access, preserving records, and referring the matter to law enforcement — for any conduct we reasonably believe violates this section.
6. Information you submit
You are responsible for the accuracy and completeness of everything you submit through the Site.
Freight and quote inquiries. Rates depend on the information you provide. If commodity, weight, dimensions, origin, destination, or handling requirements are inaccurate or incomplete, any resulting rate indication is void, and the shipment may be subject to repricing, refusal, or additional charges under the applicable transportation documents.
Driver applications. Employment and contracting applications are subject to federal motor carrier regulations. Providing false or incomplete information in an application governed by 49 C.F.R. Part 391 is a serious matter and is grounds for immediate disqualification or termination at any point, including after hire.
Unsolicited ideas. Please do not send us unsolicited business proposals, concepts, or creative materials. If you do, you agree that we may use them without obligation, compensation, or confidentiality of any kind, and that we owe you nothing in connection with them. This does not apply to information you submit through our quote or application forms, which is handled under our Privacy Policy.
7. Rate quotes and freight inquiries
Any rate we provide in response to a Site inquiry is an indication based on the information available at that time. Unless expressly stated otherwise in writing, a quote:
- Is valid only for the period stated in it, and if no period is stated, for seven (7) calendar days;
- Is subject to equipment and driver availability at the time of tender;
- Does not include accessorial charges — including detention, layover, tarping, permits, escorts, redelivery, storage, or lumper fees — unless itemized;
- Assumes lawful weight and dimensions and legally routable dimensions for the equipment quoted;
- Becomes binding only when confirmed in a signed rate confirmation or executed contract.
Transit estimates are estimates. We do not guarantee delivery on a specific date or time unless a guaranteed service is separately agreed in writing and priced accordingly. Weather, road closures, mandatory rest under 49 C.F.R. Part 395, mechanical failure, permitting delays, and conditions at origin or destination affect transit and are outside our control.
8. Driver and employment applications
Submitting an application through the Site does not create an employment relationship, a contractor relationship, an offer of work, or any promise of future work.
- Pine Logistics is an Equal Opportunity Employer. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, genetic information, veteran status, or any other characteristic protected by federal or state law.
- Any employment relationship that may result is at-will unless a written agreement signed by an authorized representative of Pine Logistics states otherwise. Nothing on the Site or in any application material creates a contract of employment or alters at-will status.
- Statements on the Site describing pay, equipment, home time, or benefits are general descriptions of our current practices, are subject to change without notice, and are not offers or guarantees. Actual terms are those stated in your individual offer, lease, or independent contractor agreement.
- Background and safety screening. Applications are subject to verification of prior employment, motor vehicle record review, a full ten-year history review under 49 C.F.R. § 391.21, and a query of the FMCSA Drug and Alcohol Clearinghouse. Where we obtain a consumer report or investigative consumer report, we do so only with your written authorization and with the disclosures required by the Fair Credit Reporting Act.
- We may retain application materials as required by federal recordkeeping rules, as described in our Privacy Policy.
9. Electronic communications, calls, and text messages
Consent to electronic communication. By using the Site and providing your contact information, you consent to receive communications from us electronically, and you agree that electronic notices, disclosures, and agreements satisfy any legal requirement that such communications be in writing.
Calls and text messages. If you provide a telephone number through a Site form and check the applicable consent box, you agree that Pine Logistics and its authorized recruiting or dispatch representatives may call and send text messages to that number, including messages sent using an automatic telephone dialing system or a prerecorded or artificial voice, regarding your inquiry, your application, or an active shipment.
- Consent is not a condition of employment, contracting, or purchase of any service.
- Message frequency varies. Message and data rates may apply.
- You may opt out of text messages at any time by replying STOP to any message, or by emailing [email protected]. You may opt out of marketing calls by telling any representative on the call.
- Opting out of marketing does not stop transactional communications about an active application or an active load.
Accuracy of the number you provide. You represent that you are the subscriber or customary user of the number you submit, and that you will notify us if the number is reassigned or is no longer yours.
10. Intellectual property
The Site and all of its contents — text, layout, graphics, photographs, illustrations, video, interface design, and the compilation and arrangement of all of it — are owned by Pine Logistics or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
"Pine Logistics," the Pine Logistics name and logo, and any related marks are trademarks or service marks of Pine Logistics Corp. You may not use them without our prior written permission, including in metadata, domain names, or advertising.
Third-party names and marks appearing on the Site — including those of equipment manufacturers, technology providers, and regulatory bodies — are the property of their respective owners and are used for identification only. Their appearance does not imply endorsement, sponsorship, or affiliation.
You may print or download individual pages for your own internal business use. Any other reproduction, distribution, modification, public display, or creation of derivative works requires our prior written consent.
11. Third-party links and services
The Site links to third-party websites and services, including social media platforms, mapping services, messaging applications, and government databases such as the FMCSA SAFER system.
We provide those links for convenience. We do not control third-party sites, we do not endorse their content, and we are not responsible for their availability, accuracy, security, or privacy practices. Your use of a third-party site is governed by that site's own terms and policies, and any dealings you have with a third party are solely between you and that party.
12. Privacy
Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you acknowledge that you have read it.
13. Disclaimers
Without limiting the foregoing, we do not warrant that:
- The Site will be uninterrupted, timely, secure, or error-free;
- Any defect will be corrected;
- The Site or the servers that make it available are free of viruses or other harmful components;
- Any information on the Site is current, complete, or accurate. Regulatory citations, service descriptions, equipment information, and compliance references are provided for general information and may change. Nothing on the Site is legal, regulatory, tax, or insurance advice, and you should not rely on it as a substitute for professional counsel or for verifying current regulatory requirements yourself.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the maximum extent permitted by law.
14. Limitation of liability
This section applies to your use of the Site only. It does not limit, waive, or otherwise affect our liability for loss of or damage to cargo, which is governed exclusively by Section 16 and by the transportation documents and federal law described there. It also does not exclude liability that cannot be excluded by law, including liability for fraud, willful misconduct, or death or personal injury caused by negligence.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Pine Logistics and its members, officers, employees, contractors, and agents from and against any claim, demand, action, loss, liability, damage, cost, or expense — including reasonable attorneys' fees — arising out of or relating to:
- Your use of the Site in violation of these Terms or of any law;
- Any information you submit that is false, inaccurate, or that you were not authorized to provide;
- Your infringement or misappropriation of any intellectual property or other right of any person or entity;
- Any misrepresentation of your identity, authority, or affiliation with Pine Logistics.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense. You will not settle any such matter without our prior written consent.
16. Transportation services, cargo claims, and governing terms
This section applies when Pine Logistics actually transports freight. It is included here so the relationship between the Site and the shipment is clear, and it does not replace the transportation documents.
Governing documents
Every shipment is governed by the applicable signed agreement, the accepted rate confirmation, the bill of lading, and applicable federal law — including the Carmack Amendment, 49 U.S.C. § 14706, which governs carrier liability for loss of or damage to cargo in interstate transportation. The Carmack Amendment preempts state-law claims for cargo loss and damage.
Terms and conditions of carriage
Unless a separately signed contract states otherwise, our published terms and conditions of carriage and any applicable limitations of liability, released rates, and exclusions apply to each shipment.
Filing a claim
A written claim for loss, damage, or delay must be filed with us in accordance with 49 C.F.R. Part 370. Unless a longer period is stated in the governing contract or bill of lading:
- A claim must be filed in writing within nine (9) months of delivery, or, in the case of non-delivery, within nine (9) months of the date delivery should have been made; and
- Any lawsuit must be commenced within two (2) years and one (1) day from the date we give written notice that the claim is disallowed in whole or in part.

Exclusions
We are not liable for loss or damage caused by an act of God, the public enemy, the act or default of the shipper, public authority, or the inherent vice or nature of the goods, as recognized under federal law.
17. Force majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, severe weather, flood, fire, earthquake, epidemic, war, terrorism, civil unrest, labor dispute, strike, government action, embargo, road or port closure, fuel shortage, failure of utilities or telecommunications, cyberattack, or breakdown of equipment not caused by our failure to maintain it.
18. Governing law and venue
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules, and by applicable federal law.
You agree that the exclusive venue for any such dispute is the state or federal courts located in Middlesex County, Massachusetts, and you consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.
This section does not apply to cargo claims, which are governed by the Carmack Amendment and by the venue provisions of the applicable transportation documents.
The Site is controlled and operated from the United States. We make no representation that the Site is appropriate or available for use in any other location. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.
19. Changes to these Terms
We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Changes take effect when posted unless we state otherwise.
If a change is material, we will provide reasonable advance notice — for example, a notice on the Site — before it takes effect. Your continued use of the Site after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Site.
20. Suspension and termination of access
We may suspend or terminate your access to the Site at any time, without notice and for any reason, including any conduct we reasonably believe violates these Terms or creates risk for us, our customers, our drivers, or any third party.
Sections that by their nature should survive termination will survive — including Sections 5, 6, 10, 13, 14, 15, 16, 18, and 22.
21. Copyright complaints (DMCA)
If you believe material on the Site infringes your copyright, send a written notice to our designated agent containing the information required by 17 U.S.C. § 512(c)(3):
- Your physical or electronic signature;
- Identification of the copyrighted work you claim is infringed;
- Identification of the material you claim is infringing and its location on the Site, with enough detail for us to find it;
- Your contact information, including address, telephone number, and email address;
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices that do not substantially comply with the statutory requirements may not receive a response. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages.
22. General provisions
Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Pine Logistics regarding the Site, and supersede any prior understanding on that subject. They do not supersede any signed transportation agreement, which governs the services it covers.
Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions stay in full force.
No waiver. Our failure to enforce any provision is not a waiver of that provision or of any other.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. These Terms do not create rights in any person or entity other than you and Pine Logistics.
Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Pine Logistics.
Headings. Section headings are for convenience only and do not affect interpretation.
Language. These Terms are written in English. Any translation is provided for convenience only, and the English version controls in the event of any inconsistency.
